BPA couldn't help on a ZZPS parking ticket

Hi,

Here is my situation. One day I received a Notice to Keeper from ZZPS out of blue saying that I got a ticket at a railway station car park and I needed to pay £124. I looked at their photo evidence and saw the yellow ticket in the photo. I suspect somebody removed it from my windscreen that day.

I then appealed the case saying I was happy to pay the original discounted charge, but not £124 because I didn't receive it and its their responsibility to deliver the ticket securely, which they didn't.

ZZPS refused to accept my appeal saying it's too late to appeal, although their NTK was saying I could appeal and I would have been given IAS if my appeal failed. They now increased the charge to £190 and threatening court actions.

I complained to BPA based on the fact they didn't accept my appeal. BPA said they couldn't help me because the ticket was issued under railway byelaws and hence not under their remit.

Any idea what I should do at this stage? I wouldn't mind going to court with them because I think I have a good case here. The yellow ticket on the windscreen doesn't guarantee the delivery of the ticket? However, if I lose, will a CCJ cause troubles when I try to find a job?

    as you are now several weeks/months into this , tell us what date the offence occurred


    ps: you do not get CCJs in a magistrates court

    OK the BPA consider this to be a bylaw offence , and as such cannot assist with an appeal


    bylaw offences are different to normal parking offences

    No, it's not that simple. And real byelaws penalties can only be laid before Magistrates' Court within 6 months of the event.

    Don't pay this, tell us more.

    Failure to pay is a Byelaw offence
    Failure to display a ticket/permit, or entering the wrong registration details is not an offence

    To whom is the payment due? Scan the reverse of the NtK please.

    well the client is govia thameslink railway , however I know where you are coming from


    there is no offence under bylaw 14 reg 27 (1) or section 219 of the transport act of "failing to display"


    as with above , please scan the rear (payments)

    Says cheques to ZZPS so this isn't a real penalty, it's the usual hybrid mess. Once six months is up they are too late to pursue it in the Magistartes court and if they were really treating it as a byelaws offence the money would not go to a debt collector!

    ZZPS letters are followed by a Wright Hassall one. See the NEWBIES thread post #4 and collect them.

    Did the driver not buy any ticket? Or did it flip over or slip out of sight? Or was it a RingGo car park - forgot to pay?
