Argos damaged tv return rights?

Just that really. On the 14th of January I purchased a tv online from Argos for my father's birthday in February, when it arrived nothing out of the ordinary other than the box being a bit worse for ware. He opened it last night and we set it up but upon turning it on there is a crack on the bottom right middle of the screen, it affects the pixels and the screen itself. You can only see the crack and pixels are only upon turning it on.

I've checked Argos 30 day guarantee and it asks for the original packaging which we'd ripped off already (not that it was in a better condition in the first place) and for the goods to be saleable but surely this can't count for faulty goods?

Could anyone please tell us our right? Do we have any rights since we bought online? And how we should proceed with this? a friend suggested claiming the money back if they refused as I paid by credit card but I'm not even sure if that's possible.

    Argos's 30 day money back guarantee is purely for change of mind purchases. This is a faulty item so return the TV for a refund or replacement as per your statutory rights. You don't need the packaging.

    How much was the TV will determine whether you can involve your credit card company.

    You should be OK..
    But.. High Value item arrived box damaged. You don't check it for 2 weeks then destroy all the packaging before checking it works.....?!

    Common sense needs an update perhaps ???
