Cancelling new mobile contract

Bought a new phone on contract from Mobiles.co.uk. In their terms and conditions it says once you have used the phone or once yoiu have used the sim you have automatically accepted the contract. But the phone doesnt do things I need it to do properly. When on hands free/loud speaker you can hardly hear the other caller, they lots of times get an echo, and if on bluetooth connection with the car the connection randomly drops and will sometimes come back on sometimes not. These are all things I use a lot. Have had the phone 6 days and obviously I wouldnt know about these issues until I started using the phone. Do you think I have grounds to cancel the contract, its for 24 months. As the phone isnt fit for purpose?

What phone is it? Dropping connection may mean bad network area. If its 4g try switching to only use 3g.
  • From their T&C: At Mobiles.co.uk we want you to be happy with your new product. As you didn’t have an
opportunity to examine your product before you received it, within 14 days from the
day you received your product we will either exchange it (in the case of a handset only) or
cancel your agreement and provide a refund as detailed below.
    14 Day Return
The returns period and the following instructions apply to contract, pay-as-you-go and
    upgrade orders.
If upon receiving your handset you decide you no longer want the handset or the contract,
then you can complete a 14 calendar days return.

After that 14 days, if the handset is actually faulty, it will be repaired or replaced under the manufacturer's warranty-their choice. Your contract is for the airtime, not the handset, and handset issues do not void your contract.

Vodafone say a similar thing when i upgrade, play with the phone as much as you like and return it if not happy. Once the SIM is inserted its mine.

Do they offer an exchange of handset? If so take that optio but your stuck with the contract unless you pay it off.
