PCN in a free car park!

Council rejected my appeal. Should I take it to the adjudicator.

I parked in Harrow Leisure Centre where it was always free parking. So I simply entered the car park and parked immediately on the left. I got a PCN by a traffic warden as it was now a pay and display car park (with first 3 hours free). Obviously I was only staying for an hour, and so there's no reason not to print out a ticket if I new about the pay and display. There were also no signs next to my lane but there were elsewhere.

Should I take this to the adjudicator?

    Absolutely ALWAYS if the discount is no longer being offered! You may as well. Nowt to lose and a good experience for you in case you ever get another one. You might lose but the amount remains the same as long as you then pay up.

    Show them BOTH sides of the PCN and the rejection letter. Don't post without.

    OK so you are not actually at adjudication stage after all.

    Post up on pepipoo and ask but explain it better on there, you are merely just past first reps stage, so asking 'shall I take it to adjudication?' is misleading and doesn't help you get an answer. There are 3 stages. But on pepipoo don't post without pics of the entire PCN. They will tell you honestly, whether they'd advise paying at the discount or not.

  • sorry to sound dumb, but I thought there were 2 stages?
    1) Make an appeal direct to the council....which I did and was rejected
    2) Wait for the Notice to Owner and make a formal appeal

    Or pay the fine now if I don't make a formal appeal

    3 stages with a windscreen PCN:

    - first reps can be made by anyone, typically the driver but could be the owner. You've only done this stage.

    - NTO stage, repeat the above but from the owner. Again this goes to the Council.

    - adjudication where you turn up (or can be done over the phone or postal decision).

    You need to either take the discount or post URGENTLY on pepipoo to ask if they think you have any grounds for appeal, or decide to appeal anyway. If you do the latter it will be all or nothing but then most people win.

    Do not post on pepipoo without pics of the PCN, BOTH sides.

    After the council reject your appeal you get the option to appeal to
    The Traffic Penalty Tribunal

    Then look at
    There has been a procedural impropriety by the council

    AND ,...
    The penalty exceeded the amount that applied in the circumstances
