pipes running through our garden ..who is liable?

we live in little cul de sac . all the houses sewerage is running through the garden into a sockaway. from what i gather the piping needs changing . who is liable is it the water board who need to upgrade them or our responsibility as in our gardens.

if in our garden can we get any insurance? thanks for any help.

    I sincerely hope your sewerage isn't running into a soak away! :eek:

    Your stormwater and any land drains might run into one. Who is saying the pipes need upgrading?

    Edit: Just noticed it's not a soak away, it's a sockaway (suppose it could be where all the odd lost socks end up? :) )

    Firstly, is it really sewage, or the run-off from roofs etc? Being clear about this affects answers people might give.

    Secondly, why do you think the pipes need changing? What's the problem?

    Do you pay the water company for sewage disposal?
    Do you pay for rain water disposal?
    Have you read your Title documents? Is there any mention of sewage?
    Is sewage really going to a soak away or is it a cess pit? Or a septic tank?

    Seems unlikely to me that youd have sewerage running from numerous properties to a septic tank in your garden. Is it a water discharge from the septic tank? Or perhaps surface water runoff from all the properties? If it serves multiple properties it could potentially be the problem of the L.A. However, if not then there should be liability for each homeowner that discharges into the surface water runoff.

    If you have a shared drain (i.e. used by at least one other property) then the common parts of it are the responsibility of the water authority. This assumes you are talking about a drain and not a soakaway.
    If you add some context to your post then you will get some meaningful info.

    If it just the surface water running to a private soakaway it is a private issue between all the contributing houses and comes under basic household maintenance.

    If it is actually foul sewage from a package plant it sounds like it could be private and the same thing as above applies.
