Clarification on Scotland PCNs IGNORE OR COMPLAIN

Hi there,
Had a read through the newbies thread etc, and seen that in Scotland you can complain to the retailer.
I recently received another piece of nonsense from Devt Recovery Plus after 3 years, when i last ignored all their rubbish.
Was just wondering if i should complain to them or keep ignoring. I feel if i complain im admitting guilt. I have absolutely no intention of paying.
I also received another letter from Brittania parking from the same car park, the other week for not paying since they installed ANPR, again i have no intention of paying and will just ignore the letters.
Thanks in advance

Do any of the letters hint that they are going to hold the registered keeper liable for the charge, or do they make it clear that the driver is responsible?
Any misleading statements can be used in complaints to the local TS up there.Je Suis Cecil.0 -
Id need to double check sorry.
The recent letter, from the case three years ago, it was actually my dad who was the RK but i was the driver, so its him this letter has went to. Ive just told him to ignore it.
I will update once i can check the wording in the letters.
Thanks0 -
my dad who was the RK but i was the driver,
In Scotland the non-driving Keeper should write back and say they were not driving; nor are they liable; and there is no requirement to name the driver. If they disagree after telling them this, then they should write to the local Trading Standards / Procurator Fiscal to save him the bother of referring them for aggressive and misleading business practices.
If they do not know Scots law, they should not be writing to anyone north of the border. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
The NEWBIES thread, specifically post 4, tells you why it is safe to ignore debt collectors anywhere in the UK.
The NEWBIES is kept up to date so nothing has changed that will affect you or your Dad, including the fact that it is still safe to ignore private parking tickets in Scotland and Norn Iron but not in England or Wales.
So, keep ignoring but let us know if the PPC try to use laws such as POFA 2012 that do not exist in Scotland.I married my cousin. I had to...I don't have a sister.

Excellent Fruitcake,
I thought as much! Will pass on the info to my Dad and be certain to mass on any more information i receive from this mob!0 -
Had an update from DRP notifying of intended court action. A load of nonsense yes?
I seem to remember when I ignored this letter the last time they actually asked me for less money than the initial charge was.
Thanks in advance!0 -
Yep, a load of nonsense.
Complain to Trading Standards that these cowboys are pursuing you, as registered keeper, for an alleged debt when they've actually got no idea if you are liable for it.0 -
Tip, keep ignoring and they'll drop the charge to zero by giving up.
Meanwhile, you could play a game of spot the dodgy grammar in their letters. Or maybe not if you're not as sad as me. :-)0 -
We know you want to, but you don't need to double check these letters (please relax and please spare us any update...):
https://forums.moneysavingexpert.com/discussion/5035663
And search the forum for 'landmark Debt Recovery Plus' or 'landmark DRP Scotland' to see all the threads exacly like yours this year so far (which is why, with the best will in the World, we can't have every letter discussed as if it's new because we can't keep up and will self combust of anyone mentions this letter chain again, as they will...tomorrow...and the next day...).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think part of the problem is that most people confuse the stupid letters from DRP titled Notice of intended court action with a Letter before Action.0
