Hi all,
I'm new to the forum.
I have exactly the same case as @wowman. A PCN from APCOA for alleged breach of picking up/dropping off a passenger outside a designated area at Luton airport. I've gone through the internal appeal to APCOA but I was rejected (same bulls### reply glossing over my arguments) so I am now putting together the POPLA appeal.
I have wowman's appeal letter and the assessor's decision to start from (thanks for that), but I am wondering if I should explicitly mention his case in my appeal, pointing out that it is exactly the same as mine and has been resolved in his favour. If so I'd appreciate any suggestions on how to phrase it.

Just copy/paste what I've used. Hell... Just copy/paste the bit about no Keeper Liability (POFA 2012) and save yourself the extra work I had to do in proof reading all of the other points I made which were completely worthless apparently to POPLA.
Or... Copy/paste everything EXCEPT the Keeper Liability and see what happens... I'm sure the community would be curious if the assessor would have ruled in my favor in case anyone accidentally gave the name of the driver away! You can't be touched with Keeper Liability. End of.0 -

Just wanted to say that I submitted the appeal to POPLA for my case, which was exactly the same as the OP's case. This time APCOA folded without even contesting the appeal. Below is the reply from POPLA:

Basically APCOA know that their operation is illegal and don't want it to be acknowledged by POPLA. I will now prepare a complaint letter to send to BPA and DVLA. I'l post it here for some feedback when I have a draft.

Tbh, behind all of this, the real A***hole is Luton Airport for employing and condoning such practices & behaviours. I fearfully dread to think how much money APCOA have made0 -

Start your own thread. Oh dear. Why didn't you just appeal using the forum template (not naming the driver) and beat this at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
