Supply of good ( implied terms) 1973 do I still have my rights to reject vehicle

I'm wondering if anyone can help me know this subject I don't want to tell the full story as it's very long so I will put it short. On November 19th me and my Partner got a car on hp a week later I noticed a lot of problems with the car. I then went on to putting a complaint through with the financial ombudsman after getting no where with the finance company or garage. I waited for a response and got one about 4 weeks later we then went on and got a pre mot inspection on the car and the garage deemed the car un roadworthy with a huge list of problems. Putting me and my family's lives at risk I didn't know about the supply of good ( implied terms) act 1973 and my right to reject within 30 days. Does anyone know if I still have these rights as I made the complaint with the ombudsman within this period? If anyone needs anymore info I will give it. Thanks in advance for any advice given

    The act you're looking for is the Consumer Rights Act 2015.

    You're outside the 30 day rejection period stipulated in it, so you might have an uphill struggle.
  • !!!!!! that's not good to hear. At the minute it's still with the ombudsman but I never got told about my rights I'm paying a lot of money for the car and it's really frustrating they have offered a repair or replacement but I have rejected this offer due to trust issues as it can be understood. Also unable to work because I can't use the car on the road. Is there any other rights I have as I haven't a clue about this. Thanks ks again

  • The fiance company have been helpful but only the past couple of weeks. They have offered for me to get the car repaired and also compensation of a month payment for the car but I'm not being greedy when I say I don't feel this is enough? in my eyes it isn't good enough as the garage have put lives at risk and also caused loss of earnings and stress. I've told them time and time again I wanted the car returning even within the 30 day period but they said it's not possible and if I wish to terminate the contract I'm to pay half of the contracted amount within 30 days. I never got told about my rights but I suppose it's there job not to let you know? It's very very frustrating for me

    During the first six months following the sale, any fault can be assumed to have been present at the time of the sale.
    It looks like the seller has accepted this and is offering a remedy.

    You have a right to a remedy, but you cannot force a seller to provide a disproportionate remedy.
    In other words, the seller can either repair, replace or provide a refund and the seller gets to choose the most cost effective remedy.

    The seller is doing nothing wrong in offering a repair.

    Section 22 of The Consumer Rights Act does allow for that thirty days to be extended if a repair is agreed within that thirty days.
    From what you have written, that does not appear to apply in your case.
  • You stated that you have been unable to work because you can't grt the car on the road.
    Do you need the car for commuting to and from work or is it needed specifically to use for your job?

    You can't moan about not being able to work if you refused a repair

    They are the exact same legal rights you have in respect of anything you buy - there is nothing "used-car-specific". It is your responsibility to be aware of your rights.
    I'm paying a lot of money for the car

    What age of car, what price of car, what did the advert say about it...?
    and it's really frustrating they have offered a repair or replacement but I have rejected this offer due to trust issues

    Which should have been a factor in your decision to reject the repair or replacement.
