Hi All,
Just a little advice needed here, I was in financial difficulty so I instructed a PPI company to claim against Northern rock . They upheld my claim and took £630 off my outstanding balance and I thought that was it. I have since cleared my account with northern rock and back on the road to recovery. This happened in August 2010, they have used a debt collector who has just written to me stating that I owe them £240 approx. this includes a fee. Do I have any grounds not to pay them? Any help would be most appreciated.

If you are in arrears, defaulted or had an amount written off then you should never use a claims company. They will bill against the total redress paid even if you do not personally get the money cash in hand (as it goes to offset debt).
If you can show that they knew before you employed them that you were in arrears then you may be able to argue your case as they are meant to point out the issues. Put in a complaint to the CMC anyway. It should be for them to prove that they asked and you gave the wrong answer, not for you to prove that you told them.I remember mentioning this to them but cannot prove this. Thank you .
I say this because, despite the fact that I consider them to be, at best, incompetent, they hold themselves out as experts in these matters - so they should have been aware of this possibility.
Make clear that you expect them not only to write off the debt but also to ensure that no reference to the supposed default appears on your credit record.0 -
