Default Date and payments on account

I had an old natwest overdraft that due to a number of reasons (yadda yadda, pay day loan spiral, any money that went in was taken straight back out so head in sand etc.) I ignored it and left it with the intention of defaulting. This was around 2012.

As far as I'm aware it should have defaulted within a few months, unbenownst to me, my dear mother, trying to help transferred money into the account every so often, which seems to have kept it open, with it only finally defaulting last year.

Am in a better position now, to pay off the debt, and reimburse me mum for the money she had put it.

The only issue is now I have a default date of 2014 whereas I was hoping I'd be at least a few years into it falling off my file. Now, everything I've read on defaults seems to relate to me acknowleging the debt, or me making payments on the debt, does a third part making payments on the debt still count as the last 'action' on the account?

Alternatively could it be argues that the account should have been defaulted/closed a lot earlier, therefor these payments wouldn't have gone through?

    Hello, I would expect the bank would treat any incoming payments to the account the same, ie even though technically not direct from you it was your income once it hits your account. Unless self employed your thinking would also suggest your wages (paid by a company or person) paid to you would not count.
    The default will remain for 6 years on your CRA file from when it was dated. You are right in thinking that an account would normally default after 3 or more successive months of missed payments. Unfortunately in your situation and your mother's good intentions this has delayed the default, they would probably argue they saw money coming into the account and delayed the default to give you more time to catch up with payments.
    Hope this helps even though it probably isn't what you want to hear.
