Help needed

my ex took out a loan in her name then bought me something with the money but she couldnt afford the payments so i said i'll give her the money. but then i stopped paying her once we split up as she got the car(that we was both paying for) and all the furniture. so then i got a solicitors letter from her to say she wanted the rest of the money so i went to the CAB and they said she could just be trying it on so i left it and moved address then unknowingly to me i got a letter from the county court at my old address and it went to court in 2011 but i didnt go as i didnt know i was meant to be there and i ended up with an attachment of earnings againest me at work the debt was satisfied in 2012. i still have a good credit rating with equifax even with that on my file but still some lenders wont touch me because of it.

Is it right that i got a CCJ over a civil matter?
And is there any way i can get it quashed or taken off my file?

Thanks

You paid it through your wages so you must have known what it was for or you would have kicked up a fuss at the time.

Yes she was trying it on but you should have defended yourself at the time. Paying it full and claiming you knew nothing about it 5 years later isn't going to work. Just wait another year and it'll drop off your credit report.
    :footie:
:p Regular savers earn 6% interest (HSBC, First Direct, M&S) :p Loans cost 2.9% per year (Nationwide) = FREE money. :p
  • thanks for the response. the thing is i couldnt of defended myself as i didnt get the court letter as i'd already moved address. so how can she go to the county court over a civil matter??

Your ex claimed you owed her money. You failed to defend the claim. By default the court will find in her favour. Simple as that.

Once you noticed you were paying through your wages you could have applied for a set aside, paid a £155 fee, based on not being aware of the case, that would have allowed you to have another court date and defend the case. Even if you didn't win it would have allowed 30 days to pay the amount and not receive a CCJ.

At this point, with it paid off I'm unsure as to whether you would be able to get a set aside.
