hello,
an oil company recently (last oct) took 300 quid out of my account for a payment, then returned it a day later but still delivered the oil. the payment was fine, plenty of money in there, so it was their mistake. only now, when i have no money after xmas, are they trying to get it back.
do i have any rights here, or am i doomed to pay them back?

Yes. You have the right to pay them their money, but to keep any interest you've gained from keeping it in the bank.0

If it was the other way round, and they'd taken the money and hadn't delivered the oil, you wouldn't even ask the question - you'd expect the oil to be delivered straight away or an immediate refund.
Mistakes happen, and they need to be put right, so, yes, you do need to pay them.
As the oil was delivered, perhaps it would have been best to put the money aside, rather than spend it, as you knew you'd have to pay for the oil at some point.
But as you've spent the money, contact them to explain this, and ask if they'll accept the money to be paid in installmentsEarly retired - 18th December 2014

I agree with the posts above. You received the oil so you have to pay them back. Did you alert them to the fact they mistakenly recredited your account? You might be within your rights to insist they come and take the oil back instead; after all, they returned the money to you without any agreement! It's possible that it may be impractical for them to do so, or even that it would hardly be worth the trouble and expense.0 -
I guess if they turn around and specifically say they cannot be bothered to collect it, so you can keep it. You could be justified in using it up.
