Estate agent suppressed offer we've made - advice please

    HouseBuyer77, I like the sound of that. I am awaiting the seller's promised email so that I can at least tell them we've made a new offer (and to ask the agent for it), but this is a good suggestion too.
    I went to see the agent just now, they swear blind it's all a misunderstanding, and that when they'd three times said my offer had been forwarded by email they were confusing me with another buyer.
    Plausible but improbable.
    They admit that my offer has indeed not been forwarded yet but promise to forward my revised offer.
    They're partly blaming the seller for being out of contact, saying they've left voicemails (probably on a UK phone that won't be turned on again for months or years) asking the seller to call the agent.

    Yes, how I wish I had taken the seller's address too.

    You arent doing yourself any favours with this EA the way your coming across on here , you bet your life they will be doing their level best to get you gazumped

  • It can happen, I was evicted at 10.30 AM, the council knew this clearly, emailed them several times, including that morning. They messaged me on my home phone number (which I could not access from 10.30) to bring my appointment with the council forward.

    I was polite but when he asked twice if I'd not gotten his message, I did point out that it was a land line I was evicted from using from 10.30. I just looked at him. Yes, they did have my mobile number. Some people just don't turn brain cells on.

    I think it's highly unlikely that the breach of contract could be considered a repudiatory breach - I certainly wouldn't think it worth risking, particularly if EA tried taking me to court.

    I would have thought it worth bringing up when negotiating their fees though - plainly the vendor has done more work than they should have!

    I agree with Dan-Dan though - I can envisage the agent coaching the other interested party with an offer to take the property off market and not discuss offers with other parties!

    Yes, Dan-Dan has a point about not !!!!ing off the agent. I'll rein it in.

    Nevertheless, it is not unreasonable for me to expect them to do what they are supposed to do (by law and according to the Property Ombudsman scheme), and to do so without deliberately or accidentally lying.

    They're estate agents! Are they a member of any professional body or in anyway regulated?

    I think that all agents are now required to be a member of some kind of scheme, and this agent is a member of the Property Ombudsman scheme, yes. How much influence TPOS has over the agent I don't know.
