Sofa issues

OK, in Oct 14 I bought a 2 and 3 seater sofa from an online furniture shop.
By June 15 a whole has developed in the fabric, where I sit the most, and the sponge padding had slipped on the arm of the other sofa.
I have a 7 year old and a 9 year old and need to cover that arm with cushions because it's dangerous. It's just wood covered with fabric now.
Both cost be around £500, so I guess you get what you pay for but they're dangerous and not fit for purpose.
I contacted the company last Autumn to complain and they eventually sent out an assessor in November.
His report stated the damage to both was down to misuse, which it's not, and that the arm is broken.
Which it's not.
He barely inspected the sofas.
They won't help with fixing them or replacing them or anything and they're dangerous.
Where do I stand?

Sorry couldn't resist.
You need to organise your own independent inspection of the sofas and then send them your report and see what they offer. If they offer nothing then you might have to sue them but not sure how much you will win as you have had use of the sofas for 18 months.

As above, once 6 months has passed, the burden is on you to prove they are inherently faulty and not the result of normal wear & tear or misuse.
If the report finds in your favour, the retailer would be liable for the cost of the report and then have to provide a remedy. However if you're saying you purchased a 2 seater and 3 seater for £500 total, I imagine they'll opt for a refund - which can be reduced to take into account use you have had. If it was £500 for the two pieces...I'd imagine it a possibility that 18 months may well be considered a reasonable length of time for it to last - especially with young kids in the house.You keep using that word. Seriously though, if it's where you are sitting it could be from studs in jeans, things like that. £500 as you say is fairly cheap for a sofa (2 sofas? Your post isn't clear) so may not stand up very well to wear and tear.0 -
