VW Hire Purchase Agreement - INCORRECT!

Hello All,

So I currently have a hire purchase agreement with VW, £255 per month.

I am currently looking at reducing my outgoings and so I've been shopping around for a new car, at the time of me purchasing my VW I remember advising the sales adviser my annual mileage is 8000.

I've just requested all my finance doc's from VW and guess what, my annual mileage limit is set to 5000!

I've signed the documentation etc, but how could the sales adviser amend this in the small print without my acknowledgment?

VW are questioning why I wanted this documentation, the salesmen that sold my car did get sacked, so I am wondering if this has anything to do with it?

What are the next steps?:mad:

    Where are the original docs that you signed?

    TBH the annual mileage allowance is hardly in the "small print". Sounds like you didn't check the documentation properly before signing. I don;t think there's much you can do about that other than pay out on any excess mileage you have.

    Having said that, if you are planning on an early VT then I'm sure excess mileage doesn't apply, although I could be wrong.

    Also, I understand it's an HP agreement but this is a PCP you've taken out, correct?

    What do your documents say about exceeding the "limit"? Is it truly a limit? This is a HP agreement not a lease or PCP!!

    PCPs strictly speaking are just another form of hire purchase and the agreement will be called an HP agreement.

    Learn to read a contract before you sign it?

    Do you have any written evidence which shows you asked for 8,000 miles instead of 5,000?

    I guess if you make enough noise about it though, VW / the dealership might change the mileage just to get you to go away

    OK, thanks. If I buy a sound system on HP are there restrictions on how many CDs I can play per week? Assuming then, that the HP agreement that the OP has signed is a lease arrangement or PCP (or whatever it is called this week) we need to wait for the OP to tell us what his t&c's say about mileage.

    If you were to buy a sound system on HP whereby the options at the end of term are pay a further amount to own it, hand it back or trade it in for another, then restrictions would be placed on the condition of the item prospectively being returned. As it happens with cars, one of the things that affects resale value is mileage. Not so much with CD players. ;)

    PCP is a form of hire purchase.

    His T&C's say 5,000 miles per annum, as per his first post.

    Excess miles above that will be subject to a charge per mile IF the car is returned to the finance company at the end of term.

    Maybe they meant new to them rather than brand new. £500 bargain could cut outgoings if you choose carefully.

  • This is a hire purchase agreement, my point being the sales adviser changed the T&C's without my knowledge and rushed the paper work at the point of me picking the car up.

    I am planning on the giving the car back at 50% mark, so this in effect isn't the full agreement
