I got a reply today from the ASA who agree that the comp code was broken and they have advised the company on best practice for the future. I guess that means a slap on the wrist and that the winner gets to keep his prizes.
Just thought 'you' might like an update.
Clearly most of the people on FB who were "threatening" sky with the asa and deep trouble had never looked/read other rulings.
The standard "punishment" after an upheld ruling is effectively "don't do it again"* and that's even if a company has completely ignored the asa during an investigation.
*The competition must not appear again in its current form./ensure that future promotions were administered fairly and included clear terms and conditions for participants/etc etc0
