    clamping was outlawed in 2012 when POFA2012 came into force

    I suspect you may be mistakenly thinking of UKPC who were defrauding people with doctored photos (not UKCPS who are a different company and no longer use POPLA for appeals)

    I emailed the maplin customer service link on their website.

    Are you saying that my chances are limited? I don't know whether I have the patience for a 6 year to and throw.

    I'd hoped that a few letters and a request of evidence to support the fact that I left the site would be sufficient to drop this.

    Noticed that another poster from hull who experienced the same treatment last year had it dropped as a GOGW.

    we are saying that once UKCPS have their teeth into this they willl harass you for up to 6 years, possibly trying a court case

    this is why they went to the IPC and the IAS, its a kangaroo court as explained in full in the newbies sticky thread

    UKCPS may fold before an actual court date, but until the 6 years is up they will send out debt letters from MIAH and all kinds of underhanded methods to try to frighten you into paying their charges

    hence why we should all be signing the Barry Beavis petition, to try to force changes in this unregulated industry

    getting the landowner or managing agent (MA) who may not be the retailer themselves, is the best method of getting this cancelled

    I doubt this will be Maplin, who may just rent a store there , like Staples did in the Beavis case

    You seem surprised. If you'd read the NEWBIES thread post #3 you would know you will NOT win the appeal and I don't recommend even trying the IAS (all explained in the thread). That's why REALLY going for the retailer is your best bet.

    I'll try a strongly worded email to the MD of Maplin. If that fails then I'll have to fall on my sword as I can't afford to have the threat of court action in my job.

    its a civil claim, not a criminal one

    even if you lost in court, as long as you pay the judgment within 28 days there is nothing on file, no CCJ, nothing !

    as I said earlier, although you may have shopped in m@plin the car park may have nothing to do with them (although try it anyway)

    I cannot understand why you are not targeting the landowner or their MA

    dont let the fact that you only shopped in m@plin mean you have tunnel vision and are wrongly blaming them instead of the retail park owner or agent

    I am not suggesting that you are. The unfortunate thing is that if I hold out and fight it but lose, I may suffer more in the long run than the £60 in the short term.

    I have sourced the email for the CEO of Maplin and as such will send a strongly worded email tomorrow.

    Other than laying it on thick about my long standing custom and my extreme disappointment at being charged incorrectly and bullied by the wording of the pcn, would you suggest any other tact?

    also asking them to tell you the details of the landowner or MA if they dont own the car park

    the Barry Beavis case was due to him going to Staples , but they did not own that car park, so I doubt they nor m@plins own this one either (maybe not the Golf one either)

    seems to me its a retail park in hull, with tenants

    its finding the MA and landowner you need to focus on, as I keep mentioning

    ask the right people , you may get it sorted, ask the wrong people and you may get fobbed off

  • How can 'leaving the site' be an enforceable contract term? What does it actually state in their Ts&Cs - these seem to have been forgotten to date?
