asda smart parking first letter from DRP

Dear People who understand this better than me,

I got a letter from DRP dated 6-1-16 saying that I had a parking Charge Dated on 29/10/15 which was the first I heard of this parking ticket. The amount is for £120 which more than the £70 that is on the signs in the car park

So I went to Asda Brighton Marina to ask for details of this ticket of when I stayed and how long for, but they said they could do nothing about it as they don't have any information about this and to contact Smart Parking LTD.

We often shop in Asda and pay either cash or by card. I checked all my CC Bills, but can't find one dated 29-10-15 so I take it I might have used cash that date. I also do take my friend with me for shopping trips who has a Blue Badge. I asked him as well if he had any receipts for that day but same problem as me none on his CC statements either.

Is there a time limit to which they should have send out the first letter to me that I did have overstayed my welcome in their carpark?

Is it acceptable that the first call comes from DRP?

I read that I should not contact DRP and will reframe from doing to, but should I contact SP to find out more details about this ticket?

What is my course of action.

Thanks
David

Please read the Sticky thread for NEWBIES, especially post 4 that tells you why it is safe to ignore DRP.

I suggest you also write to the CEO of ASDA and ask why he/she is allowing a bunch of parking scammers to set debt collectors on you when you haven't even had a parking charge notice.

Tell them you will become an ex customer if this isn't cancelled and you will tell all your friends and family to do the same as well as make rude comments on social media.

Don't hold back. Tell them this practice is not allowed by the parking company's trade association, and what are they going to do about it?

Notso-Smart Parking are BPA members so complain to them as well along with the DVLA saying the same thing. Sending debt collectors letters without first issuing a PCN is a breach of the BPA code of practice. Contact details are in the NEWBIES thread.

Others will be along shortly but PLEASE read the NEWBIES thread carefully.

If you are a regular shopper with Asda and you can prove it with CC Statements then it is not important for that day.
The most important thing is that you can prove you are a worthy customer so contact the CEO of Asda. The managers of the store do not have any authority to do anything.

You need to ask the question " do you still want me and my friends to ever shop in Asda again, if so please cancel this ticket

you also need to ask why the store staff have lied to you.

Don't think they did this time. Read initial post again. OP did ask them to cancel it, just for the details The PPC has those, not the store.

    Being pedantic! :o
  • Thanks for all your quick replies. I am putting together a letter to the CEO of ASDA and will post it on here before I sent it off. Have read most of the newbies stuff and have followed many links especially the ones Successful complaints about private parking tickets - how to get them cancelled! Which are interesting to reads.

Thanks so far and will show letter later

I do not think it is a good idea to show your letter on here as it could become a copy and paste template which would lose the effect it has on the CEO. All letters must be personal and I am sure you can write a "DISGUST" letter
  • Do you think I should give CEO all the car details etc in the first letter or wait for his response

The PPC and debt crawlers already have those details, but you probably only need to give the DRP or PCN reference numbers.

Don't forget to send the complaint letters to the DVLA and BPA as well.

Do you think I should give CEO all the car details etc in the first letter or wait for his response

Give all the details of the vehicle, PCN number and you as the 'registered keeper' (BUT NOT saying who might have been driving) and say how disappointed you were that the Store Manager didn't cancel it when you raised the matter. Also upset that this may have been a time when a Blue Badge holder was in the car with 'the driver' (you can't be sure because this was a shock, unexpected demand received weeks later) and yet it's clear that the cashier didn't ask for the car park ticket to refund/tell the driver about the scam in the car park.*

Tell them these notorious firms are driving poeple away from large retail car parks. Complain assertively and finish by saying what you would like done about it, which is why you must show them a scan of the offending fake PCN or at least quote the PCN number etc.

    * it is indeed a scam so call it what it is. I'm from this area - SEAGULLS!!!!!!! :D I expect you are aware now, but you have to pay £1 for a ticket then get that refunded at the till, even though the next door cinema car park is multi-story, huge and free and so people don't tend the use the Asda car park to do anything except shop at Asda (if they have any sense). Cinema goers and people visiting restaurants & other shops & the Marina, should park in the free multi storey, and they do.

Oh, and the signage and positioning of the P&D machines is abysmal. Very easy to miss and no reminder as you walk towards the retail store or inside.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
