Retailer vs Manufacturer: different length warranties
wiggers
I bought something from a Jersey-based online shop about 4 years ago and it has developed a fault. The manufacturer's website says it has a 5 year warranty but the retailer is saying they only give a one-year warranty.
What can I do?

The retailer doesn't actually have to give any warranty at all. What they are giving is a 1 year warranty for them to handle any issues.
After this one year period you are free to make use of the manufacturer's 5 year warranty, provided that you've complied with the terms of the manufacturer's warranty (which may include registering the item with the manufacturer, and exclude certain fault types or issues).
Of course you are always free to make use of the Sale of Goods Act (SOGA) and claim against the seller. But after 6 months from purchase it would be your responsibility to prove the fault was inherent (present but not apparent at the time of sale). SOGA does not apply against the manufacturer, unless they were also the seller.0 -
In reality retailers don't actually give a warranty, instead they have to follow the SOGA. Manufactures give the warranties.
After 4 years to chase the retailer will be pointless as you have a lot of hoops to jump through but using the manufactures 5 year warranty should be easy if you have set it up properly. Give them a call and take it from there.0 -
They are separate warranties-one does not exclude the other. No free lunch, and no free laptop

If it's still under warranty with them then it may be easier dealing direct with the manufacturer.0 -
Bear in mind OP did say it was a Jersey based online shop, therefore UK legislation (such as the SoGA) won't apply. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

Correct .. the Jersey equivalent to SOGA will apply - unless the shop's T&Cs mention the contract is subject to English law. (Unlikely, but you never know).

I can't see the point in jumping thorough whatever hoops are necessary to persuade the Jersey retailer into a remedy when the manufacturer offers a 5 year warranty as standard.0
