looks like all the "stayed cases" will now be reheard, which is a good outcome

Well done to everyone who applied the pressure and turned the screw till the BPA broke down and sobbed. This one is a real victory for people power and thank Goodness that the ISPA existed to make sure the voices were heard this time. Well done Nicola Mullaney.

  • Certainly sounds like good news.

I don't want to put a damper on it but we are still relying on Troy boy getting off the golf course and doing something.

He probably choked on his tea and garibaldi biscuit when he got the news, but I'm sure he's working on his delaying tactics as we speak.

So - I have the letter the BPA sent to Nicola Mullaney at ISPA. She was kind enough to forward me a copy.

I would post it, but it will be on Prankster/BPA/ISPA websites before long. Simple summary
    - appeals judged on the full points raised, beyond commerical justification alone
    - new evidence will be allowed

The when and how is not detailed. So we will have to wait for news on that one.

Overall, great job by ISPA and the other stakeholders and consumers who have been lobbying. This shows that with our support ISPA, under the current leadership, have influence with the BPA. And credit where credit is due... BPA and Patrick Troy saw the light in the face of the evidence.
  • Yes, a big "thank you" to the ISPA for their efforts.

Nor is the "by whom" detailed; Mr. Troy's letter states that "the BPA Board has agreed to instruct the service provider appointed to consider these cases to do the following.....".

Based on a separate e-mail received from the BPA this morning, it would seem that the appointed service provider is not POPLA. The BPA has advised that a "new and independent service provider will now consider these appeals in their entirety"....."ISPA has appointed two new auditors to oversee the work to ensure judicial independence is maintained".

I suspect that we will need further assistance from ISPA to ensure that the new provider is not only independent but also competent.

The BPA adds that "the decision making process will commence shortly and it is anticipated that motorists should start receiving the outcome of their cases next month".

I think I'd be asking what training the new provider will be undertaking, especially in light of the fact that new POPLA still hasn't got all its ducks in a row to adjudicate anything that is remotely resembling a Beavis-type case.

Let Trouser Fire provide absolute assurances, rather than assume it's all ok cos he said so!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Don't see how they can if they are also giving operators and appellants the chance to add final representations to support their case, post-Beavis, (which WAS promised). Emails from old POPLA, as far back as April 2015, undertook to allow people to add more comments after Beavis concluded and before a decision was made on their case.

Correct, just how many fully trained adjudicators are there around ???

Adjudicators must be fair minded people, but new people ??? where does Troy get his ideas from. A recipe yet again for another TROY c..k up
  • Agree CM, Umkomaas... but hopefully the prima facie / non Beavis grounds can be sorted quickly. Or perhaps I am just too hopeful in nature.
