It is yes, i can see this becoming a bit of a nightmare the problem is all my post gos to my parents address and i work away offshore so shes having to tell me whats come through the post and it can sometimes be a few days or weeks before i find out whats come through the post if contacts bad, il fill the forms in and send them back along with the statute barred forms and hope for the best, thanks again for the positive input0

Hi guys bit of an update i recieved a letter back from mortimer clarke today stating the debt wis not statute barred as there was a payment made on 23.03.2012 iv had a look through my bank statement for that month and no payment was made by myself, i was going to ask mortimer clarke to send copies of the transaction as i know iv never paid anything toward the debt i wasnt living at my parents address (were the debt is registered too) when theyve said a payment was made and have also checked my parents statement and no payment was made?? Is there a chance they could be trying to just put pressure on us as we dont have any record of making a payment and i know that iv never paid anything toward the debt.

they make up payments all the time hoping you wont challenge it or a judge is stupid enough to take their word

Have you already defended this or at least acknowledged the claim?
You have to do one or the other within 14 days of service, which is deemed 5 days after issue date. It can be done online using the password on the claim form
So in Fermi's example,
issue date 14 Mar 2014
service date 19 Mar 2014
deadline for acknowledgement 9 April
then full defence 23 April
If you miss the timescale you will get a 'default judgement' ordering you to pay the whole amount immediately. This is then more difficult to deal with.
