Hi everyone.
Iv recently paid off what i thought was all my debt.. so i thought i had numerous loans and credit cards and paid them all off however had an outstanding loan to cabot that defaulted in 2008, and came off my credit file a few years ago now but recently iv had cabot financial pop up threatening to take me to court and today i recieved what looks like a CCJ from them, the letter is saying the claiment is cabot financial and the address for sending payment too is mortimer clarke solicitors.
Does anyone have any information or help that they can give i was under the impression that after 6 years the debt became statuatory barred and you could no longer be chased for it? Iv never had any other baliff or solicitors letters just this last month every few days letters from either mortimer clarke or cabot.
Thanks everyone please help a guy in need :-/

They can't just send a CCJ, the case has to go to court first, as mark says, please elaborate a little more on what you have actually received.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi guys.
Iv had literally over the last month probabley 2 letters basically saying i had an outstanding debt, i didnt acknowledge them then today i had a letter which says i owe money to cabot financial through mortimer clarke solicitors who will be representing them, the loan was originally through sainsburys in 2007 and defaulted less than a year later, iv not paid anything toward the loan in well over 6 years to be honest the letter looks a bit iffy im sure its not an official letter of any sort and dont know if there just trying there look to scare me into paying as iv never had any correspondence with mortimer clarke or cabot in the past other than when i paid off a different debt with hsbc through them last year maybe thats flagged something up on there system that iv made a payment on another debt previously i dont know0 -
The letters just a simple black and white letter with a column saying who i owe and who will be representing them then in another column my name and address and then at the bottom theres a summary of what i owe including solicitors fees.0

So it's a letter threatening court action, rather than actual blue court papers.
As part of the pre-action protocol, civil procedure rules, they have to write to you to tell you court action is imminent.
If that's the case then the account looks like it's statute barred, and you should write and tell them so straight away.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Send them the statute barred letter template from here and inform them you will make a full defence of statute barred at court and any malicious invention of fictitious payments will result in an immediate complaint to the FSA and SRA and CSA.I do Contracts, all day every day.0

Let us know how they respond, as its not unheard of for them to "invent" a payment in order to prove there case to you, of course putting false evidence in front of a court would be a different matter altogether.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
