Hi my wife parked in a cap park in Carlisle but exceeded it by 7 minutes she actually saw the officer walking away from the car smiling at her. She got the letter through the post saying that she has to pay £100 or £60 if paid within 14 days. We feel that the charge is a bit excessive as we have parked there many times before and left the car park before the paid time was up and not got any refund. I have read the Newbie page and sent a letter of Appeal using the template, we have just received a reply which i will post below as i am not sure what to do next.

Thank you for your appeal received on 2016 regarding the above detailed Parking Charge Notice. We have reviewed the case and considered the comments that you have made. This appeal has been considered in conjunction with the evidence gathered by the Parking Enforcement Officer. Our records show that the notice was correctly issued. The vehicle was parked on private property in a manner which attracted a Parking Charge. The Charge was brought to the attention of the driver by the signage which is clearly displayed throughout the site.
The photographic evidence which can be viewed online at removed URL, clearly shows the Pay & Display ticket displayed within the vehicle at the time the Parking Charge Notice was issued had expired. It is the responsibility of the driver to ensure when the vehicle is left it fully complies with the Terms & Conditions of parking. Unfortunately in this instance this was not the case.
We are therefore unable to cancel the Parking Charge Notice as it was issued correctly. We have now extended the discounted payment period by 14 days to allow you time to pay the discounted settlement amount. Please now make payment of £60 to reach us by /01/2016 or £100 to reach us by 02/2016. We must advise you that once the discounted settlement rate passes it will not be offered again.
Payment can be made by debit or credit card online at mwp or by using our 24 hour automated telephone payment line on 0845 123 7919 (Calls will cost 2p per minute plus your telephone company's access charge). Please note debit/credit card payments will incur an additional surcharge. You must have your PCN reference number and Vehicle Registration Number when you make a payment. Alternatively you can send a cheque/postal order made payable to 'Northwest Parking Enforcement Ltd', please write your PCN reference number and vehicle registration number on the reverse.
If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). The Independent Appeals Service () provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you submit your appeal to them within 21 days from the date of this rejection letter .In order to appeal the IAS will need your Parking Charge Notice number, your vehicle registration number and the date the charge was originally issued. Please note appeals submitted to the IAS automatically revert to the full amount of £100 and the opportunity to make payment at the discounted rate of £60 would no longer apply.

Write back and demand access to a appeals system that meets the basic levels of Alternative Dispute Resolution.
As the IAS falls considerably short of all ADR guidelines as a ADR service , think more circus clowns riding bikes carrying buckets of custard...I do Contracts, all day every day.0 -
please remove details , ie: pcn number, exact dates etc , why did the "warden" not place a ticket on the car? , secondly do a forum search for the words "grace period"Save a Rachael

Simple, appeal to IAS, they will send you a ridiculous anonymous reason for refusing you. Bank it, and then ignore.
Show it to a judge if they are daft enough to try court.You never know how far you can go until you go too far.0 -

I say do not appeal to the IAS and the reasons for my advice and other alternative views are linked in post #3 of the NEWBIES thread. Please read it to understand you will LOSE at IAS (if you try, I say don't) but not to pay.

The use of a premium rate 0845 telephone number is a breach of the industry Code of Practice. The premium is the additional Service Charge paid to the benefit of the called party and their telecoms provider. Usage of this type of number causes the caller to also incur an Access Charge of up to 12p per minute from landlines or up to 45p per minute from mobiles.0

HI I've just had the following reply after asking for access to a appeals system that meets the basic levels of Alternative Dispute Resolution.
Dear Mr
You have been sent the letter declining your appeal and this clearly states the options available to you,
1. Pay the Parking Charge Notice
2. Appeal further utilising the Independent Appeals Service which is provided by the Independent Parking Committee who are an accredited ADR.

did you ask them if the abided by IPC rules and allowed a "grace period" , either they did not allow it , or they failed to abide by the IPC code of practice and obtained your details illegally from the DVLASave a Rachael

My earlier advice still stands, get on with your life, collect the letters in a drawer marked 'scam' and ignore anything except court papers (extremely rare, especially with small firms like this one).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
