Employer not paying Tax

A few people left my workplace recently and discovered that their taxes have not been paid since may 2015. I called today to check mine and its the same ..nothing since 5th may 2015. Another ex employee who left in august just checked but hers is fine. So seems like they pay some of ours but not everyone.

I receive tax credits so a bit worried this will cause problems when I do my renewal

Do employers have to pay hmrc each month or are they allowed to do it whenever they're ready? I'm getting worried now that I'm now going to have problems

    Yes, this is their responsibility.

    Is you pay advice showing an income tax deduction as usual?

    Its very strange that some people's tax was paid and not others.

    When you pay tax/NI you just pay an amount under a reference for that company (and month). Plus give a report on what deductions are made from staff.

    So they know what you owe and if you underpay/not pay, they can't just allocate it to some people and not others. They'd allocate to everyone and chase the company for the debt.

    So sounds like they are not even submitting payroll records correctly, hence no tax recorded for you but there is for others. Maybe you are not on the books?

    How was this 'discovered'? is this due to not being detailed on pay slips? or has the actual records of what was due, and what was paid been seen?

    Can you confirm, are they declaring your pay and tax details to HMRC but just not paying over the tax

    Are they not reporting it to HMRC?

  • It was discovered because an employee who left in December called HMRC as she was having problems with receiving a P45. She discovered that tax and no hasn't been paid since may. Another ex employee checked this and same thing so group of us called today and 4 had the same thing...2 were fine and 1 has had payments stop in September. A few were also asked if the company had closed may and that when this happens it looks as though we've been unemployed this whole time.

    We did get a new accountant in may last year so not sure if this has something to do with it.

    I doubt they are going through a rough patch and are unable to pay especially as i just got a pay rise

    It seems as though they are not declaring /reporting any tax and ni details for the past 8 months

    If they aren't reporting anything then this could cause problems. It would look to HMRC (including tax credits) that you aren't employed.

    If it was simply a case of them reporting the details but not paying it, t wouldn't affect you.

    What have HMRC said they are going to do about it?

    Is management aware? Perhaps there is something else going on - system issue, employee doing something fishy etc.

    I'm astonished that this could happen WITHOUT the company being aware: before RTI started HMRC used to phone us if they thought we were late paying over what was due. Now there's RTI there are fines for late payment / non payment!
