samsung smart tv from currys

hello just wondering if you can help we bought a samsung 48in smart tv from currys in may 2014 payed 699.00 for it but the tv stopped working last week no picture it had 12 months guarantee which has ran out we went back to currys who told us get on to samsung which we did but the say we have to pay for repairs we have found out it is the screen which has gone by a good tv engineer and currys should either replace or provide a replacement tv can you tell me what my rights are and where to go from here as we come to a blank surely with a screen it should last longer than this many thanks

    Is that engineer willing to provide a report saying that the fault was inherent at time of purchase?

    If so, you can ask for a repair, replacement or a proportionate refund.

    Without a report you have no legal right

    Most people would agree that the screen should last longer but the retailer is only legally responsible if you can prove that the fault is due to a manufacturing defect. (bad materials or assembly). This is why you need a report stating that the screen has failed due to an inherent fault. (something that was there at the time of purchase but has only just manifested itself).

    As it currently stands, there is no way for the retailer to know if the TV has broken because of something that you have done to it. I'm not saying that this is what happened, but you have to be able to prove this before the retailer has to do anything.

    Things become faulty for many reasons. It being faulty is not a reason for them to act.

    You need to prove they sold you an item that was not fit for purpose from the start, faulty soldering, dodgy wiring etc. Not something that could have been caused by it being knocked, moved, etc

    Just to partially repeat what others have said, when marliepandy said "the fault was inherent at time of purchase", that doesn't mean the fault was obvious or visible at the time of purchase. Inherent has a more technical meaning.

    It basically means that some fault existed when you bought the product, perhaps a bad solder joint or a sub-standard component. Over time this fault has caused the situation you now have to occur.

    So you need a report from your engineer saying what the technical reason for the fault was, and clarifying that it's not misuse.

    You then provide this report to Currys (note even if they try to fob you off, you must provide it to Currys - you claim against the retailer, not the manufacturer). They should then offer a free repair or a partial refund. If the engineers report cost you money, Currys should refund this too.

    If Currys still refuse to do anything, even with the report, you'd have to take them to the small claims court. Unfortunately they aren't known for being a particularly helpful retailer, and will probably try to fob you off as much as they can, so it's up to you to decide if you want to bother.
