mis-priced digital goods

Hi I went to a site that advertised a product at £24 and then i saw another site run by the same person with the same product at £96 I purchased the £24 product but the site owner asked for the other £72 saying that the site I purchased from was invalid I said to him that the error was his and he should have removed the invalid page and not allowed me to make payment he replied that the page was invalid and refunded my £24 I am wondering if this is correct can he do this. any feedback would be welcomed thanks.

    In answer to your question, it largely depends on the terms and conditions of the website. When do they state acceptance occurs?
  • Hi i cant see anything that states when acceptance occurs I paid through pay-pal and should have received the download link straight away

    That's not what the OP's post says. It says that payment was made.

    It all depends on the T&Cs of the site.
  • there appears to be no t&c on the site for any product that is purchased through it, the link I took went straight to pay-pal I made payment and waited but nothing arrived and then site owner said page was invalid and asked for extra or offered refund. I just felt that as he had received payment a contract was in place if the page was truly invalid it would not take me to payment site.

    I doubt if you'll get anywhere with this without putting in a lot of time and effort (which may be wasted). Is the product worth £96 to you? If it is it'll be easier just to buy it, if not, do without or look elsewhere for a better price.

    Payment alone is not acceptance, a payment is made by the computer, just an automated response. Acceptance takes place when the transaction is processed and either accepted or refused. Acceptance would be the download link sent, in this case the offer was refused.


    This is standard practice now in the computerised age payment is always made but is never seen as acceptance.
