item removed by ebay but I've already paid

Bought GBA game on ebay from seller I've used for months Paid by PayPal then got this mesage from ebay:

"The following listing xxxxxxxxxxx was removed because the intellectual property rights owner notified
eBay that the listing potentially infringes its copyright, trademark or
other rights. Due to this claim, and the fact that the feedback system
is no longer available, we strongly urge you not to complete this
transaction.

No idea what to do..seller is one of these enromous Hong Kong sellers who has automated reply on emails, plus his id has gone. Can I stop or retract through paypal? Just need advise really

  • Have a look through some of the other threads on 'item not received'. You'll be able to start a chargeback on Paypal if you don't receive the item. There is a time limit for doing this, so you'll need to be on your toes to complete. See if you can find Soolin, she'll steer you right.

    Buyer Complaint Policy

    PayPal’s Buyer Complaint Policy covers goods that are purchased and not delivered, and goods purchased on eBay and paid by using PayPal that are “significantly not as described”. Buyer complaints must be filed within 45 days of the payment and, even if the buyer’s claim is justified, the buyer will receive a recovery only if there are funds in the seller’s account. RECOVERY OF YOUR CLAIM IS NOT GUARANTEED.

    PayPal (Europe) Ltd's Buyer Complaint Policy only applies to tangible, physical goods which can be sent in the post, and excludes everything else, including but not limited to: intangibles, services, quasi-cash and all non-tangible, non-physical goods. In addition, items prohibited in the PayPal Acceptable Use Policy are ineligible for coverage. An eBay item is 'significantly not as described' if the seller clearly misrepresented the details of the item in a way that affects its value or usability. Please note that this does not include cases where the buyer is merely disappointed with the item or where the item did not meet all the buyer's expectations. If you file a claim for a 'significantly not as described' item, you will generally be required to return the item to the seller at your expense.

    For eligible eBay transactions, PayPal automatically applies eBay’s Standard Purchase Protection Program. A separate eBay claim is not needed. See eBay for details and eligibility.







    Filing a Claim. Before filing a claim, contact the seller and attempt to resolve the dispute. If you are unable to resolve the dispute in this manner, file a claim in PayPal’s Resolution Centre.

    PayPal will contact the seller and investigate your claim. If the claim involves non-delivery of goods, the seller must present appropriate proof of dispatch to the buyer’s specified address. If the claim is granted, PayPal will seek to collect the amount from the seller. PayPal may also limit the seller's access to his or her PayPal account. If there is more than one claim against the same account, we will process the claims in the order they are received. You will also be entitled to the return of any and all funds we are able to collect from the seller for funds received by us prior to the seller's account status having been changed to limited access. RECOVERY OF YOUR CLAIM IS NOT GUARANTEED.

    Claims must be filed no later than 45 days from the date of payment. Only one claim may be filed per transaction. We will seek to resolve the claim within 30 days of the date filed, though such time frame may be extended, if appropriate, to accommodate the investigation. This policy applies only to the sale of tangible, physical goods and excludes all other sales and services, pursuant to section 1 above.


    Credit Card Transactions. The Buyer Protection Policy does not replace or reduce any other consumer rights Users may have, including reversal rights that may be granted by a User's credit card issuer. You acknowledge that we do not control the outcome of any reversal decision initiated through a User's credit card issuer.

    We encourage all buyer purchase disputes to be filed and resolved through the PayPal dispute resolution process, and buyers are requested to identify in their claim the PayPal policy they wish to rely on (if appropriate). We reserve the right to terminate or limit account access privileges of buyers in any of the following cases: abuse by a buyer of the reversal process provided by the buyer's issuing bank; filing a chargeback against an unauthorised transaction; consistent failure to pursue PayPal's Buyer Complaint Process before pursuing any alternative reversal process provided by the buyer's issuing bank. If a chargeback claim is initiated, whether as a result of a dispute or for any other reason, the parties agree to provide to any requesting party on a timely basis any and all necessary documentation to resolve any reversal or dispute. PayPal DOES NOT act as the agent of either party in any transaction or resulting dispute, though we do control the outcome of disputes initiated through the Service's dispute resolution process.

    On day 7 start the paypal claim, unfortunately (and it is one thing that irritates me in these circumstances) you can't start the claim before then even though ebay have told you not to deal with this seller.
