Consumer rights act 2015 for 'click and collect' laptop

Hi, I found a laptop online and in the product description it states 'over 8 hours of battery' but I'm finding it only lasts 3.5 hours. I chose the click and collect option and my husband went to the store to collect and pay for it. Anyone think I've got a case under the Consumer rights Act 2015? I feel it's not as described as I chose to purchase based on its description online, although I'm unsure if click and collect will be treated differently if, say, the in-store shelf labels state a different spec (which I wouldn't have been aware of as we didn't browse and decide to purchase in store). Thanks for your help!

  • Is the quote "over 8 hours of battery" exactly what is written on the advert or is it something like "up to 8 hours of battery"?
    It's only a few words difference but those few words make a lot of difference.

    Provided that the ad does state "over 8 hours" (and if possible, print out a copy of this for proof) then I think you have got a case. Whether the retailer agrees is a different matter though.

    Just had a look at a variety of laptops online (Tesco/Argos/Currys) and in all the descriptions the batteries say "Up to X hours"

    All depends what you use the laptop for. Playing solitaire will decrease the battery life a lot less then playing one of the latest games, likewise browsing the nex will consume less battery then watching movies.

    Have you got a link to the actual laptop?

    Up to 8.15 hours. That's in ideal conditions. In reality we all have apps and programs running in the background that drains the battery and we don't even know it.


    Click and collect when paying in store is not a distance sale. Click and collect when paying online is.

    I think that this could go either way.
    The item description states:
    - Over 8 hours of battery life lets you work wirelessly for longer
    but the specification page states:
    Battery life Up to 8.15 hours

    As there is no CD/DVD drive (which is something that uses a lot of power), there is a hell of a difference between the advertised "up to 8 hours" and the 3.5 hours that are being provided.

    I'm on the fence about this one.

    Had it not said "up to" on the specs page, I'd say it is misleading - since it says it allows you to work wirelessly for longer giving the impression it will last for over 8 hours throughout use.

    With contradictory information on the specs page though, I'm not sure whether this would mislead the average consumer. Surely consumers would be (on average) aware of the difference between standby life and in use life? It pretty much applies to any mobile electronic device.

    However no harm in OP approaching retailer and trying though.

    Don't forget that the statement about the "over 8 hours" battery life doesn't state anything about the device being in standby and it clearly implies that you can have it working for those 8 hours.

    Unless the OP catches them on a good day at PC World I can't see them agreeing, but it's certainly worth a shot.

    ETA: Somethings only misleading if its likely to mislead the average consumer and cause them to make a different economic decision (to either not enter into the contract or to not enter into it on the same terms).

    I'm suggesting that perhaps (just perhaps), the average consumer may not be mislead when presented simultaneously with both statements - that they would understand it to mean that its up to 8 hours and not guaranteed.

    Someone made a mistake when writing that description. However that is not your fault and they have mis described unintentionally but still mis described. Send the screen shot to customer services.

    To add I had a washing machine which was mis described which I bought from Curry's. The child lock didn't function as would be expected. I didn't realise for several months because my youngest wasn't walking. Curry's agreed to replace although I did have to go through customer service rather than the store because they fobbed me off saying I needed to deal with the manufacturer. I often find their customer service team is better at resolving complaints than stores themselves.
