respondant's solicitor legal responsability?

help me please.....


During discovery I have discovered that my employer has repeatedly accessed my medical records without my consent I have audited proof of such and know this is in breach of DPA told their solicitor and requested aditional info of who else viewed to be told" not Relevant to this matter"

am i right that solicitor is on dodgy ground being aware of an illegal act ?

    1: who is your employer?
    2: There is no central medical record, perhaps the company keep THEIR OWN records on you
    3: A solicitor is not on dodgy ground, being aware of an illegal act. They just cannot claim to not have knowledge of it. Just like anyone else really!
    4: How do you have 'audited proof'

    Your doctor would not release information without your written consent. Are you saying they have forged your signature, or has your doctor not followed procedure?

    We definitely need more information.

    i work for nhs gp surgery as I.T tech

    and took an audit of who has viewed my records after Manager berated me for a particular consultation report and had printed it off. it also showed others had viewed too one colleague actually repeated specific information in this in writing

    So the respondent is a GP/ group of GPs, and is this your current employer? Have you asked why they have accessed your records?

    What is the basis of your claim, is the accessing of your records relevant?

    If that's true, £5 to a choice of charity. Just name the surgery.


    1: GP surgeries very rarely have their own IT support, most are a single small building, the larger practices buy in their IT support. An NHS trust of 5,000 employees only qualifies for an IT team of about 12.
    2: There's no such thing as an NHS GP
    3: If you worked in IT you wouldn't type as you do
    4: Your employer may well have access to your files via you contract of employment (this is more for anyone else reading this)
    5: You are in breach of the DPA if you've used your position to find out who has accessed your files, or if you yourself have accessed those files - it amounts to gross misconduct.

    I suggest you change GPs..... Then your records can go else where.


    However this isn't true is it.

    ridiculous answer - an ongoing legal action, yes gps are nhs and it is a health centre
