Bought a second hand game from cex on 19/12/15 for my son for Christmas when I opened it there scratches on the disc but I presumed it would have been tested and I had been told that there was a 24 month warranty so I wasn't too worried. When my son tried to play it after xmas it came up saying the disc couldn't be read-tried a few times but wouldn't work. Tried to return it today with my receipt and they refused to do anything at all and said that they "wouldn't buy or sell a game in that condition and that they would presume that I had caused the damage to the disc".! Tried to reason but they refused point blank. Is there anything at all I can do in this situation?

they are notorious for that , although you should of checked it in the store how many people actually do that

CEX are a truly awful company, I had major issues with them over the Xmas period and will never use them again. They are more than happy to mislead people over their consumer rights, something which I am led to believe is a CRIMINAL offence? I've even tried contacting their CEO but no response from them.
They are notorious for this, the only problem is they have no idea about consumer law and what their responsibilities are.
I would message them on facebook and twitter, although it can take a few days before you get a response. I know it’s no use now but whenever I bought things from them in store I always checked the disc beforehand. They buy any old tat and then palm them off to others, like you have now found out.
I assume from what you said you bought in-store.
I wish nothing but ill for CEX and the sooner they close down the better, but I would definitely try the social media route which might bear fruit.
