ParkingEye Charge (Bought a ticket but got charged - no evidence HELP!)

I've not used this site before, but I'm wondering if anyone can give me some advice on the following:


I was issued with a parking charge on 23/12/2015 at my local pub but I believe it was unfairly issued. They recently (on the 3/12/2015) introduced the pay machine so I was aware I had to purchase a parking ticket and I'm adamant I did so.


I entered the car park at 20.38 and parked up. I entered my registration into the machine, paid and received the ticket which I displayed on my dashboard. The machine issued a second part of the ticket which (if I spent over a certain amount I could get a refund on my parking). I went into the pub with my friend to purchase drinks and received a refund on my parking as I had paid over the amount to be able to claim it back. Upon leaving at 21.57, I discarded the ticket as I usually do as I hate clutter in my car and went on my way.

I then received this parking charge. It's frustrating because I can't recall how much I paid for parking so I don't know whether it was a case of overstaying the time or it could've been a possibility that I may have mistakenly entered my registration number.


I have contacted the pub to request a copy of the second part of the ticket that showed I had received the refund on my parking (and tell me how long I had paid for) as I thought this might help my case but unfortunately they could not find anything.


Do you think it is worth appealing my case without any evidence or just sucking it up and paying the discounted charge. I'd have to pay by the 19/1/2016 so any advice would be greatly appreciated.

    go back to the pub and tell them to cancel it ...... you where a customer ....... but you will never be again if its not canceled .....

    is it a pub chain ?

    if so also appeal to the ceo @ head office

    Thanks for replying.
    I wouldn't dream of ignoring it, but doesn't feel like I've got much of a leg to stand on without any evidence. The parking charge has a photograph of my car and reg so they have proof I was there.
    I have been in contact with the pub but they said there is nothing they can do and that I have to go through ParkingEye. I've already told them how frustrated I am and that I'll think twice about going back there again in future as it's extortionate.

    The main thing I'm worried about is I could be worse off for appealing as I would then be unable to pay at the discounted price and be down £100 which is ludicrous :( I just don't know if they'd take my case seriously because I haven't got the ticket and it would be my word against theirs.

    in future keep all receipts for a minimum of 6 months and a maximum of say 2 years (or 6 years)

    this can be appealed on several legal points, as can be seen in a typical PE popla appeal

    it may well be that the wrong VRN was put into the machine , leading to this pcn , so that is one query point but there are several others , like no contract , poor signage, not a gpeol , no loss to the landowner , plus a witness statement saying the driver paid for parking

    learn more about this topic, then you wont make assumptions like "not having a leg to stand on"

    also ..... tell the pub landlord ..... is it a free house ? is it part of a pub chain ?

    that you are defending this and ... and ... and if it gets to court he may well be called ........ tell him your friends will all sign truth statements to say that they where all there and you did pay .... (if they will of course)

    ask him if you should post on the relevant facebook / trip adviser pages to warn future customers ......

    as Redex said there are lots of ways that parkinlie can and do mess up .....

    with forum help winning at POPLA must be near to 100% .... IMHO

    so take both courses of action .......
