            Has he been in hospital all the time since July? If so, you should have phoned up DLA and told them as that is suspended 4 weeks after going into hospital and when he comes out you would tell them and then it would be restarted. If he has been paid DLA all the time he has been in hospital then he will need to repay that as it will be an overpayment. Also, if any extra payments of severe disabilty premiums on other benefits from being on DLA will have to be paid too. He will have a large amount to pay back
I know this as I am due to go into hospital and was told to phone DWP as soon as I go in hospital.0 - 
            Yes he has been in hospital all the time, I was merely paying his bills. Up until late November they wasn't sure if he was coming home or going in a home. I have no power of attorney and so I didn't inform them. Had I known I had to I would have done so. I can't cancel his bills, close down his home or anything else official because I don't have permission to do so. Had he lost his mind it wouldn't have been a problem but the only problem besides his physical health is he can't care for himself and is a danger to himself.0

But you said in your first post that "the council will be paying for his care due to lack of funds".

            Yes he claims pension and the local council have a maximum figure they will pay for care, in my father's case it is £412 per week of which my father is liable for £126 ish which comes out of his pension leaving him £24 per week.0

            Even if he gets pension credit that is taken into account when deciding his contribution to the care home. He will be left the £24 after his amount is determined. If he is entitled to pension credit but doesn't claim it he will be assesed as if he has it anyway.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -
