Mobile phone problem - refurbished replacement?

Hi,
I wonder if someone can give me some advice please? I bought a mobile phone from the Google play store in September. The phone as developed a hardware fault. They have offered to replace it with a refurbished phone. Is this reasonable or can I insist or a new replacement? I know I'm not covered by the Consumer Rights Act which only come into effect on October 1st but surely the Sale of Goods Act covers me?
