    When I logged into POPLA it says:

    Decision: Successful
    Assessor rational: ..."I am allowing the appeal on the grounds of the grace period. ..."

    I'm assuming that mean the appeal won... if not that may have been a premature celebration. haha! :cool:

    its great to see that POPLA have allowed an appeal on the basis of clause #13 of the BPA CoP and especially as you paid for 4 hours parking yet they still wanted their pound of flesh, yet it cost them £30 or more to lose at popla, more fool them

    these parking companies need to start making allowances for grace periods , like the police may do when they prosecute at a percentage over the speed limit , say 37 mph in a 30, but not 32 in a 30 mph zone

    too many times we see them being over zealous over a few minutes, yet its clear the CoP allows this grace period

    looks like the assessor went for this big time instead of those other issues like no notice to hirer or whatever, lol

    a great win all round

    recently , POPLA seem to have allowed for various issues that we bang on about, like

    NO LANDOWNER AUTHORITY
    EXPIRED LANDOWNER CONTRACTS
    GRACE PERIODS (Clause #13 of the BPA CoP)
    POOR or INCORRECT SIGNAGE (including failing the BPA CoP)
    NTK FLAWS
    No NTK sent to the keeper of the vehicle within 29 to 56 days (non-anpr)
    No transfer of driver liability to keeper under POFA2012
    POFA 2012 not valid on non-relevant land (so no transfer of driver liability)
    No Notice To Hirer in their evidence packs when its a lease or hire car

    on a side note from another thread

    its also great to see that POPLA have been leaned on such that they now appear to have a Lead Adjudicator and will refine their processes, well done the ISPA, lets hope some people get reassessed
