Travel Agent & Debt Collectors?

Sorry, unsure where is the best place to post this.
Basically, I booked a holiday over the phone with a travel agent, who is a 3rd party. I paid a low deposit and the remaining deposit balance was due 8 weeks later. Circumstances changed and I called them to let them know I would no longer be taking the holiday and had to cancel. They've now passed my details to a debt collector to collect the remaining £350 deposit.
My question is, am I legally liable for this? I'm not in a position to pay the money at the moment but I want to know if they can record it against my credit file (I didn't sign a credit agreement, or sign anything).

  • When you book a holiday on a low deposit deal it usually says in the terms and conditions that even if you cancel you are liable for the remainder of the deposit. You need to check the terms and conditions. When you accept them and pay the low deposit you are saying that you accept liability for the payment. If you do it online there are usually tick boxes.

    Thanks, it was all done over the telephone. They then emailed me paperwork which includes a 'booking documents' sheet asking for a client signature against terms and conditions. But no T&C's supplied nor did I sign and return anything. Just wondering if they can legally pursue this.

    The cost of changing names would be more than the amount I've already paid.
