Retailer trying to claw back money

Hi,


I recently purchased goods(electrical) at a cost of £300. I paid by card, and forgot about the transaction. Now, several months later, the retailer have contacted me saying I owe them more money because they did not charge me the correct amount. Having looked back at my bank statements, they have only taken £40 from my account instead of the £300. My question is, do they have any right to claim back the money as it was their mistake. I am worried because it is now after Christmas and I don't have that money available anymore. The receipt I have has the correct goods with the original price, but the price has a * and a note saying something along the lines of 'reduction included'.


Any advice would be great. Thanks

    yes you do, you agreed to pay £300 and haven't paid them £300

    The payment being taken is completely separate to what was contractually agreed. The contract was xyz item/s in exchange for £300. You have the items, they don't have the £300 (yes its their fault they don't have it but that doesn't change what was agreed).

    On the other foot, had you agreed £300 and then discovered they had taken £3000, you'd be entitled to the £2700 back.

    You could very well ask them to take it in instalments. But its going to have to be paid to them in one way or another.
