Help to Buy ISA with divorce

Hi, I'm writing this on behalf of my brother-in-law whom has his ears closed regarding the help to buy ISA. He hasn't really considered it, but is also 'not doing anything with money' until he gets divorced.

He separated from his wife approx 18 months ago, and is hoping that divorce proceedings will be started this year.

He is saving for a deposit (by paying back a 'loan' to his mother on a monthly basis), but not currently in the help to buy ISA scheme. If he starts paying this money instead into the scheme, would his wife be able to get her hands on it when they get divorced - considering all the money has been saved since they split?
