No Umkomaas , I was not sure what you were trying to say with your comment , and oh I do apologise for accidentally missing an 'h' while typing my reply haha.
As for me, I am a new driver of a years experience, thus why my knowledge of these subjects are small. I like to think I am a careful and considerate driver and I was not aware of the time limit which was operating in this car park, as afore mentioned. I plan on trying to find other places to park where possible. I am glad that I will not need to stress about paying some fine that I need not pay however as mentioned as a student and after bills every month extra money making scams like this is not what I need!

As for asking Tesco about use of the car park, do you think this would be a venture worth trying to pursue?
I can imagine them just telling me where to sling it to be honest!

I was aware that clamping is not used here in Scotland however I was unsure of the things involved when being issued with a parking ticket and I said am relieved that I need not worry!

But do heed pappa golf's warning, that if you do build up a stack of these, you become increasingly vulnerable to a court claim, rare, but not unheard of in Scotland. However, get two week's worth by ignoring the PPC and you're looking at £1,000 in unpaid parking charges - well worth a punt for the PPC in the courts, even in Scotland.

Don't go into this with your eyes closed! Sleepwalkers often fall downstairs.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I will wait and see , however I do think they will send out a ticket as I arrived in college at about eleven and did not leave until about half five. Again, as mentioned, being unaware upon entering and when I found out it was too late!

I hope there is a resolution for this as there are a lot of students who use the car park , hopefully parking in the area will improve.

as well as studying the Protection of freedom act (2012) and KODOE agreement , you might want to try asking your friends in the law department to define the word "fine" and to explain to you who or what authorities are allowed to issue fines .

once you are happy that you understand the relevant laws applicable both in England and Scotland (highpoint are England based) then you can decide.

however , good and bad news . Highpoint are the "ranger" group , a company (probably the largest) that gleen and gather drivers info from the DVLA , although illegal they probably have the largest database in the Uk , now the good news , they do not like court http://www.bmpa.eu/companydata/Highview_Parking.html

    thanks for that Golf.
From what I previously understood however not sure if I am correct is that in Scotland, the only people you NEED to pay is the council and the police. Private companies cannot force you to pay those fines. Would I also be right in saying that there is a difference between a fine, and a charge ?
For example, I believe that if I did receive a letter from this company that it would be a charge, which means it does not need to be paid, where as a fine does.

Again I am not sure if that is correct because I am not clued up on these things.

    Thanks

a private parking co would have to go to the county court and (in Scotland) prove it was you.

in England if they comply with the POFa they can go after the keeper if the driver is not named , in Scotland this does not apply.

however if people admit they are the driver (Scotland) or for a multi blatant case) perhaps photography evidence could be used and they would start charges.

I still feel that if this gets out of hand the coll(a)ge would act to keep face.

Krreen, you are abusing Tesco, it is a car park for their shoppers not to be abused by students with nowhere else to park.
Regardless if you pop into the shop, that is not an invitation to park whenever you want, its private land.
Best tell all your student pals because they will also get tickets
