Missing credit card refund

Help. I recently spent £300 on my credit card on furniture in m&s which when delivered turned out to be faulty. They came to collect the items and issued at full refund a week later. During that week I was a victim of fraud and I ended up having to cancel my credit card and was issued a new card. After nearly 2 months of liaising with the bank and m&s I still have no refund. M&s say they have transferred the money back to the original card but the bank are saying they cannot find this payment. Any help or advice please as I am getting very frustrated

I guess you could try initiating a section 75 claim for the original payment for breach of contract.

(M&S's agreement/contract said they would refund you if you returned the furniture. You have received no refund - so they're in breach of contract.)

Going down this route is likely to get the attention of more senior people at M&S and the CC company - not just customer service agents - so it may get resolved quicker.

Did M&S give you a receipt/email confirmation? There is a claim for missing refunds-it needs to have the date, word credit/refund a reference to your credit card. Send a copy to your bank and they can claim it back for you.
