Lump Sum to pay debts whats best way to offer to creditors?

    I have asked for the payday loan information via complaints email of the following payday loan companies following the link sourcrates kindly provided.

    Email Sent 05/01/2016 WagedayAdvanceLimited Outcome 24/01 TOLD ME NEEDED SAR EMAIL SENT BACK TO SAY JUST NEED STATEMENT. 06/03/2016 NOTHING FURTHER HEARD last automated reply 12/02/2016. 12TH APRIL DEADLINE BEFORE ESCALATING TO FCA
    Email Sent 05/01/2016
    Satsuma Outcome 24/01 COMPLAINT LOGGED VIA EMAIL. LETTER RECEIVED REJECTED 22/02/2016
    Email Sent (actually filed on there website) 05/01/2016
    Lending Stream (debt now with motor-mile finance ltd) Outcome 11/01 email reply received COMPLAINT LOGGED VIA EMAIL 11/01 SETTLEMENT AGREED AND PAID 06/03/2016 AWAITING CLOSURE STATEMENTS UPDATING OF CREDIT FILES

    Email Sent 05/01/2016 Quick Quid (debt now with Pra Group Uk) Outcome COMPLAINT EMAIL USING GUIDELINES FROM SITE REFERENCED 08/01/2016 FURTHER REPLY STATING INVESTIGATING RECEIVED 11/01/2016 06/03/2016 nothing further heard as of yet they have until 11/03/2016 to respond (8 weeks) if not heard will escalate to FCA. ESCALATED TO FCA 10/03/2016 VIA EMAIL


    CCA REQUEST SENT TO BARCLAYS 06/01/2016 UPDATE WHEN/IF RECEIVED GIVEN UP WITH UNWILLING TO COMMUNICATE 06/03/2016

    Could somebody confirm it is ok to email the original payday lender in the bottom two cases even when the debt is now showing with a third party?

    Thanks again every making progress albeit slowly but better than none.

    And the last thing for today as that took a fair while and its getting a bit much.

    On both the reports i have access to at present my barclays debts are still showing as being owned by Barclays.

    I believe from some searching that there is little point in doing a CCA request on the overdraft. However i want to do the CCA request for the loan as suggested last night.

    Could somebody point me to a recent example of the correct thing to send to Barclays please??

    Please treat this letter as a formal request for you to supply a copy of my
    Consumer Credit Agreement
    as is my entitlement under sections 77-79 of the Consumer Credit Act 1974.

    I require you to provide me with a true copy, or reconstituted copy of the credit agreement relating to any account you deem to be mine, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit.

    Your obligation also extends to providing me with a statement of account. I enclose a £1 postal order, which represents payment of the statutory fee payable under the Consumer Credit Act. I understand that a copy of my credit agreement should be supplied within 12 working days from the date of this letter.

    If it is your view that you are not the creditor, s.175 of the CCA1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189.

    I understand that under the Consumer Credit Act, creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

  • I have finished the cca request to Barclays as above. Will post tomorrow recorded delivery with a £1 p order payable to Barclays Bank Plc

    Will update post when posted for my peace of mind.

    Will next update after that when i start to hear back from the payday loan people.

    already had one reply from one of my payday emails saying "struggling to find me on their system".

  • As stated in post have emailed quickquid a complaint using the excellent template on the payday loan refunds site, have adapted for my circumstances.

    They are my smallest debt in terms of payday loans so probably good to practice on them first so to speak.

  • Received my credit expert pin so now have that report to look at as well

    Wonga is showing as a settled account and a default but with a zero balance (written off by them) which i was aware of but is good to see on the screen. Is this the correct way it should be displayed after they have written it off?

  • Had a reply from quickquid who have acknowledged the complaint and will get back to me within the 8 week timescale.

    Have had a reply from Satsuma via email. "we are happy to deal with your request, however we need written confirmation to our head office also enclose a £10 admin fee."

    So need to do that then :)
