Sorry if I am being a bit dim (this is all new to me) If the aunt was paying my ex's partner then surely it wouldn't go through an agency, as in effect my ex's partner would have to be employed by the agency. In addition to that it has been sworn on oath that she works 9 hours per week not 35 AND her income is more than £89 per week.

Your partner's ex may not be getting Carer's Allowance - which is from DWP. She may however be getting the money for 9 hours caring via Direct Payments - which is money awarded to a person by social services for the client to 'buy in' their own care.
The client then chooses who they want to do this work - and in this case the client has chosen to employ her niece for 9 hours per week? The aunt would have been entitled to buy in this help via an agency, but has chosen not to in this case.
Up until very recently in this area, the council's client financial services would have administered the payment of this money to the carer - in this case her niece - and issued payslips etc
That changed last year here (now they have to sort out tax etc between themselves, or pay a 3rd party to administer it), but may still exist elsewhere.The IVF worked;DS born 2006.0 -

kw0116, it would be best if you started your own thread. Click on Benefits and Tax Credits and then you will see a button saying New Thread near the top of the board.
Also more information will be required such as what other income you have, whether you work, whether you have a partner and/or any children, whether you rent or have a mortgage etc before a meaningful answer can be given.
