No fault claim tesco car insurance help pls

Hello I had a no fault car crash last September, car was a total loss. other side admitted fault straight away ,
problem is other party's insurance hasn't paid my insurance company tesco , the cost of my car back yet. So I am paying £90.00 a month , when I should be paying 45.00 .
I am tierd of ringing tescos & getting fobbed off, every time I ring they say it will have to go to court , lie about court dates, & they say can't give me my no claims back until the cost my my car £2300 has been recovered from privilege, has everyone heard of anything like this before? Would be greatfull for any advice thankyou in advance

    Have you renewed your policy since the claim?

    You claimed on the wrong policy, you should have claimed against the other party if you were 100% of liability and made them claim on their insurance.

    There is no incentive for your insurance to get the job done.

    You may have to look at cancelling your claim and claiming against the other party to get things moving.

  • Your insurers are right. They have paid out for the write off cost of your vehicle. Until they recover their full outlay, it counts as a fault claim because they have paid out on your policy.

    What were the accident circumstances? Was it the third party who admitted liability to you? They may have reneged on that in which case there will be a dispute on liability which will ultimately have to go to Court if it cannot be settled. If liability has been settled but Privilege won't pay Tesco their outlay, Tesco will still have to take Privilege to Court to recover their outlay.

    Unfortunately it's quite normal. If you make a claim on your own policy it will be treated as a fault claim until your insurer has successfully recovered their costs from the other party's insurer, and this can cause you problems (higher premium, loss of no claims etc) if your renewal comes before the process is complete. If liability is not in dispute you can get round this by bypassing your own policy and making the claim directly against the third party's insurer - but it sounds like it's a bit late to do this now.

    Unfortunately insurance companies tend to work rather slowly and several months for the claim to be settled is not at all unusual. Dountless it's a big deal to you, but to Tesco and Privilege it's just one of many thousands of claims that they're processing at the moment - and not even a particularly big one.

    The good news is that if/when the accident is settled in your favour, the claim is reclassified as no fault and your NCB is restored Tesco should refund any extra premium you've paid in the meantime.

    It took almost 2 years for my mums non fault claim, the other side admitted fault but didnt reply to any messages sent, until court was mentioned then they would reply then stop replying again..
