Car Insurance Excess Refund Confused

Hi

Hopefully I'm in the right place to ask this question heres the background

Last August whilst pregnant I was in an accident, after having damage assesors and accident assessors agree that the damage to side of my vehicle was the other drivers car rolling backwards into my car from a side street whilst I travelled down the main road. (i know it seems unbelieveable but hand on heart thats what happened)
I paid my excess etc and due to the cost of repairing the damage (2 x reinforced doors boosted costs) the insurance written it off however the car is fully driveable and I bought my vehicle back as its an excellent car.
Anyhow the other party has told 4 different stories etc as he will not admit fault, I am aware from my Claim Handler that at least 2 different Solicitors have withdrawn their claims after they have received info from mine with the clear evidence.
The other party insurers requested a 50/50 settlement stating that due to both of our stories not matching which my insurers have replied stating NO as its their clients fault from that point the decision was made to wait to see after my twins birth, physio and time to rest to see if I would recover from my lower back pain.

A few weeks back I received a letter from the other parties solicitors claiming for injuries to the driver which would cost around £10,000 which prompted me to contact my Solicitors and Claims Handler to discuss which the decision was made to start proceeding to take the case to the court.
Well when I came home on New Years Eve there was a letter on the door step in the letter it states
' On behalf of the underwriters of the above (other parties insurers name) we are pleased to enclose a cheque for £$$$$ to cover your policy excess'
Can anyone advise what this means as my Insurers is not open until Monday

It means that the other party is settling in your favour.

Although for some reason, in a combination of pounds and dollars...

It normally means their Insurers have accepted liability

Lol I'm sorry its just my work habit of blocking out money value when passing details

TBH I'm just really suprised, I thought maybe there could be another reason like their paying it now but will claim it back if its settled as 50/50 or the court decides that its my fault
That I just had to come on here and ask, it would be an amazing start to 2016 if they have decided to accept liability I've struggled so much this pass year with the increase of insurance with being on Mat Leave, looking after 2 babies and not being able to get the things I've wanted for them. so if its true my two monkeys are going to be soooo spoilt this year once its all settled

So the other side claims to have suffered £10,000 worth of injuries as a result of you driving your car sideways into the back of theirs.

I can see why their insurer decided their policyholder's testimony might not be believed in court.

I trust that you and your twins are remain in good health.

Congratulations. It's a good time of year to get something like this out of the way.

I was hit by a car whilst on my bike. He tried to deny it but after getting my information and a witness account from a third party his insurer settled on his behalf, without his agreement. So it does happen that the insurer will decide there isn't a strong enough case, despite the policyholders protestations.

    Hi

Contacted my Insurers today who have advised that the other parties insureres has paid my excess and for their (my insurers) outlay. He is currently awaiting confirmation from the other parties hire company if they are stopping their claim for payment. Once that is confirmed they can close the claim as no fault to myself. OMG SOOO HAPPY
My insurers will then recalculate my insurance and also pay me back for the extra money I paid for the year befores insurance.
    My new questions are-
I bought my car back do I request that back from my insurance as they have been paid for their outlay or does the solicitor make a claim for that?
The money I will begettng back for all my extra payment should that include interest that I would of made if the money was never paid out in the first place (I know they do when is missold ppi)?
    thanks again

Do you mean you got paid the write off value less the salvage value and you kept the car?

If so you cannot get back what you paid for the salvage (as in you can't have your cake and eat it)

See if your solicitor can get a sum off the third party regarding interest you have lost.

The car was never salvaged, due to costs of repair being a higher value than the cost of my Insurers wrote it off at a value of £2250 I checked with the garage and they advised the car was sound and I asked the Insurers instead of scrapping a good car (Its the best car I've ever had, never lets me down) could I buy it back off them so the charged me £450 for the car and removed my excess £160 I received a cheque for £1640 I used this to pay towards the repair of my car and put the rest towards it.

Your car became "salvage" when it was written off - you bought the salvage for £450.

You can't now claim that back off the third party! (and have already got your £160 excess refunded)
