ParkingEye £60 fine

Hi

I read some other threads on this and have a similar situation.
My wife owns the car. She is disabled and has a blue badge.
I dropped her off and went into the Long Term Disablement hospital to drop some shoes off to be worked on. I had dropped off my wife a few minutes earlier in fact her disabled badge was still on display as I was going to pick up immediately afterwards. I've taken her there many times before but on this occasion we received a letter in the post with again 2 photos of the car saying we didn't gain the correct parking permit. I have no idea how to do this and am due to pick up the shoes in a weeks time.
I don't know whether to complain or ignore.

Any advice would be appreciated.

firstly , its not a fine , its an invoice

secondly, if this was in england or wales then only a fool would ignore it and anyone ignoring them can expect to defend a court case in the small claims court within a year or two (they have up to 6 years)

a BB isnt valid on private land but the EA2010 is, so you need to know what the rules are on the private land where the vehicle was ticketed by these ANPR cameras (that is all they would have used, nothing human checking a BB at all)

suggest you read the blue booklet you got with the BB, it will tell you where you can park and why, plus it also tells you to check private land before parking or stopping

presumably something was required that you failed to follow, perhaps a permit, a payment ticket or putting your VRN into a machine at reception ?

you should have checked the signage when stopped, you didnt appear to do this and so that is why you didnt know what to do, so always check the signage when stopping somewhere

now please read the NEWBIES sticky thread and appeal it, if this happened in england or wales

if your wife is the keeper then she would have received the postal pcn, not you

do not reveal who was driving

yes complain to the landowner and try to get it cancelled

DO NOT ignore ParkingEye, they sue people. Just send a first appeal, not saying who was driving. Details in the NEWBIES thread.

Obviously when you go back, do not use that car park.

If you have a Blue Badge you can park for 3 hours on double yellows or single yellows ON STREET, as long as you cause no obstruction, do not park close to a junction and not where there are 'kerb blips' in yellow indicating a loading restriction.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They should not mention the Beavis case, but if they do, come straight back to us.

Can you do this on private land / hospital?

no , I believe she means on public roads like council roads, on private land its important to read and follow the signage and the same options and restrictions do not apply
  • Thankyou for your replies. I did read the signage in the car park. I'll go back and check over the weekend and I'm sure that it says disabled badge holders can park free. My wife doesn't have a good memory but she thinks that on previous occasions someone has input the car registration into somewhere in the hospital. I didn't do that. It wasn't clearly marked anywhere to tell me to do that only that disabled badge holders are free.
According to the dates on the ticket 2nd Jan is the end date for the £60 payment and the 16th Jan is the last date for the £100 payment.
I'll write to ParkingEye dated 2nd Jan and appeal and complain about the lack of instructions how to input the car details and explain the disabled badge.
By the way yes she is allowed to park on yellow lines. However there aren't any as its a big hosp[ital car park. We both cant walk any distance as I'm recovering from a broken leg and she is permanently disabled.

as its a hospital car park those yellow lines dont apply, its private land, so dont make that mistake either

any complaints should be to PALS at the hospital

your PE appeal should be done online by your wife (the keeper) - or you doing it on her behalf, but online, on their website , do this today , tomorrow or as soon as possible

you will be required to input the VRN on a terminal inside the hospital, this is probably why you received the pcn, for not doing so

read the blue booklet again and ensure you know where you can park, plus in future check signage and if in any doubt, ask, dont assume

enclose a pic or scan of the BB when she appeals it, but DO NOT mention who was driving, assume it was me driving

do not explain yourself to them or prolong it, stick to keeping it simple for now, plus contact PALS at the hospital and complain about this tivket and this convoluted registration process too

You and I both know people can't, necessarily, because private firms make up their own rules to suit them.

In case it was unclear, even though I mentioned kerb blips and loading restrictions, I've just added 'on street' to my post which is what I was trying to tell the OP. It was late when I posted but I did also make it clear by saying:
Obviously when you go back, do not use that car park.
To the OP, I was telling you not to park in that car park if the rules are not clear. Why risk it? Park on street on a yellow line with a Blue Badge (rules as stated already above) or use the drop off then park on street.

And appeal the PCN with a copy of the Blue badge, not staying who was driving. You are the registered keeper (we assume?) so you appeal as that person. The NEWBIES thread tells you how.
