Faulty present bought in EU

Hi, this is my first post so apologies if this has been covered before, I couldn't find anything by searching the forums.

My husband bought me a new Clarisonic as a Xmas present, whilstb in Austria in November. It is likely that it doesn't work because the battery wasn't maintained by the retailer whilst in stock - apparently they need to be charged every 3 months or they die.

Clarisonic UK say they won't repair under warranty unless also bought in UK (this seems a bit of a cheek since all their items come with a US plug and are therefore universal!)

Could anyone advise the quickest/most successful route for a repair/replacement/refund?

Badgering Clarisonic UK?
Attempting to contact the Austrian retailer to ask for a refund?
Using American Express purchase protection?

Something I haven't thought of...?

    Your rights are with the retailer, not clarisonic.

    For the record, my uk bought clarisonic has no US plug, just the usua UK three pin.

    Clarisonic UK's warranty clearly states that it only covers product purchased in UK or Ireland.
    As a manufacturer's warranty is in addition to your statutory rights, this restriction is perfectly legal.

    If an Amex credit card was used (rather that a charge card), and the product cost over £100, then your husband's easiest course may be to seek a remedy under Section 75 of The Consumer Credit Act.

    How long did you charge it for? It does say 24 hours but if its not been charged for ages then it can take 3 day to kick in.

    To be honest there is no way the retailer will open a brand new product to charge it up.

    My Clarisonic(bought in 2009 and still working), and those I have seen in stores all have the UK plugs. The universal I have seen for sale on Ebay and the sellers say you need to buy an adapter for the UK.
