Fridge freezer under 2 years old

His all,
Please could you help......?
I have a zanussi fridge freezer ZRB34211WA purchased 22 January 2014. On 22 December 2015 it started making a terrible noise, very similar to the sound of a numatic drill!

Currys are refusing to do anything as I didn't purchase their extended warranty. They say EU 2 year directive doesn't apply as SOGA is in place, yet they refused to accept that less than 2 years is an unacceptable length of time for the appliance to last....

What do I do? The noise is just dreadful! I'might not inclined to have to pay engineer call out fees etc for something that shouldn't be happening. What is an acceptable length of time for a fridge freezer to last?

    If you want to pursue your SOGA rights, then you now have to prove that the fault is due to a manufacturing defect, something that will require you to get an independent report detailing exactly what the problem is.
    Provided that you get this proof, Currys should then provide a resolution in line with their SOGA responsibilities (repair, replacement or refund, which may be a partial refund) and they should also then cover the cost of obtaining the report.

    As it currently stands, there is no way that Currys know that the appliance hasn't failed because of misuse and the onus is on you to show the cause of the failure.

    Just to add in, the 2 year eu directive was incorporated into UK law via the sales of goods act.

    However this directive is widely misinterpreted by people - usually with them thinking that the directive gives them a 2 year warranty in the way we would usually use the word warranty (ie manufacturers warranty with repair/replacement). in reality, it was setting the time limit for consumers to bring legal action against retailers. In the UK, we have much longer than this - 6 years from purchase under english law and 5 years from discovery under scots law.

    The same directive is also responsible for the 6 month burden - in that after 6 months, it is for the consumer to prove the goods were inherently faulty. Which is what shaun mentions above.

    Furthermore, technically directives aren't binding on currys. If it were regulations then it would be binding EU wide, but directives are really only instructions to member state governments. Its up to them how to implement it, just as long as the overall goal is achieved.
