MightyDeals still haven't refunded me from a purchase made in October. Help!

I claimed a voucher on the 17th October to purchase an iPhone 5 for £177. I got the phone about a week later and had it for about a week. The battery life was shocking and it wouldn't charge very well and would need constant charging. I notified them on the 28th of October.

I sent the phone back (don't have the receipt at hand at the moment).

On the 24th November I emailed to ask if my replacement phone was on its way. I emailed again on the 2nd December asking for the replacement phone.

Finally, I got a phone number and talked to some folks the iPhone suppliers to Mighty Deals sent an email stating:

"Please refund customer - goods have been returned to merchant - please refund in RealCash
"

This was the 7th December.

I have talked to some people in MightyDeals and they have said the refund was being processed. Yet here I am on the 30th December still unable to get an answer OR a refund. I have sent emails to them chasing up on the 22nd December, 29th December, raised tickets through their support system and not one single person has responded.

I have sent an email saying that I have to consider legal action but no response yet.

What a shambolic company and service. I've spent 2.5 months chasing them and now probably another 2 making a claim.

What are my options? Is it small claims?

    Call your credit/debit card issuer and ask for a chargeback.

    Just to add, you would only proceed to small claims once you had written a letter before action. There are certain requirements it needs to meet in order to comply with the civil procedure rules.

    But as above, try a chargeback if paid by debit card. If you paid by credit card then its a section 75 (section 75 of the consumer credit act) claim - given that the price was more than £100.
