Any rights of return?

My daughter purchased a short for me and picked the wrong size for a large company.

She however added a pocket.

I suspect that they have in stock both shirts with and without pockets and they did not customise it specially.

Their terms however state no change or refund on shirts with pocket alterations.

Do I (or my daughter) have any rights?

    You can ask, but it's a bit of a long shot.

    The company don't have to refund or exchange anything as they have provided exactly what was asked for - the product isn't faulty, you have just changed your mind because you ordered incorrectly.
  • I ought to add they accept returns even if worn or you change you mind etc.

    Was also purchased online.

    However my query is over whether they can exclude the pocket as I do not think it is a customisation as i think they stock them anyway.

    They also offer initials etc., on them which is 100% customisation.

    If its a selection for a fixed list of variables at the point of purchase they should not be classed as personalisation - If there is any form of open field for specifying characters or customisation then this wouldn't be allowed to be exchanged.

    A company legally does not have to accept any returns unless the product is faulty (which yours isn't).

    This company has decided accept returns for change of mind for some items, which is generous of them but they do not have to. They have specified that whilst they will accept some items back for change of mind, they will NOT accept items with pocket alterations.

    Unless the product is faulty, they don't have to do anything, and likely won't - they will point you to the terms that you have already quoted.

    You can't be sure, the OP said it was bought on line and still maybe within the 14 days for notification of return.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
