Online Retailers Storing Banking Details After Transaction Without Permission?

Online Retailers Storing Banking Details After Transaction Without Permission???

As far as I am aware online retailers cannot store banking details after a transaction without expressed permission to do so. The following link from BBC is only credible source I can find this information. bbc.co.uk/webwise/0/22728224
I personally never store banking details and get very upset when companies do. I've noticed around 5 companies that are fairly well known around the Xmas period that have stored my banking details without permission. When I complain I get ingnored. One company actually addressed the issue. :j
Is there somewhere I can actually see it written in law so to speak so I can show the ignorant ones not to ignore me lol. Who would I complain to once I've given them time to react? OFCOM, Data Protection People etc etc. They must be breaking laws somewhere or another.

Thanks for your help or guidance. :T:A:T:j:j:beer:

(Companies also keep sending my password to me by email once I register. Surely this is wrong also???)

Are you certain you didn't agree to it when you ticked the 'I agree to the T&Cs box'? What websites are you referring to, so we can check them out?

I'm inclined to agree with SuperHan that you probably have agreed to it, but if you are sure that you haven't and you have evidence that the data has been retained then the responsible body is the Information Commisioner's Office https://ico.org.uk/.

If you mean that when you first register they send an initial password or link that you need to use to verify your registration, and you then chane the password to a new one, then I can't see what is wrong with that....

Data protection legislation says they shouldn't keep data longer than is necessary.

Good luck proving they don't need it longer than you think is necessary. ;)

Most companies use an independent payment service provider for payments. These companies have to keep your card details as you may need to be refunded. They feed back to the retailer the card token which will often be something that looks like the card number eg 4124 XXXX XXXX 3214. In reality however this isn't actually your card they have stored.

The card token is how a retailer settles a transaction against an order.

In reality they have not stored your card, they are just unwisely displaying your card token.

therefore from a PCI point of view they're covered.

Might it not be better if you stopped buying items online?

Surely the tin foil hat you wear prevents you from spending money online?

I had a problem with 123-online for a number of years. When I made a payment online, they recorded my card details and used these for auto-renewals. I protested and categorically told them not to store my card details or auto-renew anything on my account. They would not agree and pointed to their T&Cs. They played his game of cat and mouse with me for some 3-4 years. Eventually I took all my business away from them and went elsewhere.

I cannot believe that they can make up their T&Cs and store your card details against your wishes. But its a long fight going through ofcom.

But as you agreed to a Continuous Payment Authority when signing up, how do you expect them to take the annual subscription, that you agreed to at signup, without your payment details?

So who do you think should make up their T&Cs? Somebody has to do it otherwise there won't be any.
