near end of iva unknown ccj
Options
Hi this is my first post I am nearing the end of my iva 2 payments to go and decided to use clear score to check credit rating, not much point upto now,and found a ccj issued 31 Jan 2010 which was issued to my old address I have moved from 3 years previously not sure which creditor it applies to just wanted advice as to whether contact iva administrator or let the 6 years pass put some money aside and wait for the debt collection agency to contact at some point and deal with them I did read that by making contact about it the 6 year period could be deemed as starting again I don't want the sleepless nights to start again wondering the best course to take
Thanks for any advice anyone can give

Hi,
As long as the CCJ applies to a debt included in your IVA, you will be ok.
When your creditors accept the Arrangement the are all legally bound by its repayment terms.
This means that any CCJ which is already in place is overturned once your IVA is accepted. The debt is repaid within the Arrangement in the same way as all your other unsecured debts.
Even if in the time that it takes to start the Arrangement one of your creditors manage to apply for a CCJ or get an attachment of earnings against you these things will be automatically overturned once it does eventually start.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi umanu
Welcome to the forum - I hope you do check back in at some point to see these replies, as you happened to post your question at probably one of the quietest times of the year on the forum!
If this debt is one included in your IVA, then as sourcrates says it's going to be gone once the IVA runs its course. If it's not included for some reason (and the best way to check is by contacting your administrator) then it won't matter whether you contact them within six years or not - legal action has already been taken, so the usual time limits no longer apply to the creditor.
Contact your IVA administrator for peace of mind.
